CV-BY-JD is operated by an individual as a personal project, not by a registered company or corporation. This means:

• The service is provided on an "as-is" basis with no warranties
• The operator's liability is strictly limited to the fullest extent permitted by law
• The service may be discontinued at any time without notice
• In case of service termination, all user data will be permanently deleted
• No guarantees are made regarding data preservation or service continuity
• Users should maintain their own backups of important data

CV-BY-JD provides AI-powered tools for resume creation, editing, and optimization, including:

• Resume builder and editor with AI assistance
• ATS (Applicant Tracking System) compatibility scoring
• Career advice and mentorship through AI chat
• Resume parsing and optimization
• Professional formatting and templates

4. AI-Generated Content Disclaimer

Our Service utilizes artificial intelligence and large language models (LLMs) to generate content, suggestions, and advice. You acknowledge and agree that:

• No Guarantee of Accuracy: AI-generated content may contain errors, inaccuracies, or inappropriate suggestions. We do not guarantee the accuracy, completeness, or suitability of any AI-generated content.
• Not Professional Advice: Content provided by our AI is not a substitute for professional career counseling, legal advice, or other professional services.
• User Responsibility: You are solely responsible for reviewing, editing, and verifying all AI-generated content before use. You should not rely solely on AI-generated content for important career decisions.
• No Liability: We disclaim all liability for any consequences arising from your use of AI-generated content, including but not limited to failed job applications, career decisions, or any other outcomes.

5. User Accounts and Responsibilities

To access certain features of our Service, you may need to create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized access
• Be responsible for all activities under your account
• Use the Service only for lawful purposes
• Not attempt to circumvent any security features

6. Payment and Refund Policy

All sales are final. We provide 3 free credits to all new users to evaluate our service before making any purchase. We do not offer refunds for any reason, including but not limited to:

• Dissatisfaction with AI-generated content
• Technical issues or service interruptions
• Changes to the Service features
• Unused credits
• Account termination, suspension, or deletion
• Credits are forfeited upon account deletion

6a. Use via ChatGPT (CV By JD app)

Access to CV By JD via the ChatGPT app is governed by these Terms in the same way as our website. Anonymous calls are limited to a small free quota; continued use requires a Google sign-in. Credit purchases are processed only on www.cv-by-jd.com via our existing payment providers (Razorpay, Stripe, Dodo Payments). OpenAI's terms also apply to your use of ChatGPT itself.

7. Referral Program

We may offer a referral program that lets you share a personal referral link and earn a cash commission when people you refer make a qualifying purchase. Participation is optional and the program may be changed, paused, or withdrawn at any time.

• Qualifying purchases. Commission is earned only on purchases above a minimum order value. Our smallest credit packs do not qualify. Commission is calculated on the amount actually paid, converted to US dollars at the exchange rate recorded at the time of purchase.
• Rates and thresholds. The commission rate, any bonus offered to the person you refer, the hold period, and the minimum payout amount are set by us and may change. The values that apply to you at any given time are the ones shown on your referral dashboard.
• Hold period. A commission is not payable immediately. It becomes payable only after a hold period has elapsed, during which it may still be reversed.
• Refunds and chargebacks. If a referred purchase is refunded, cancelled, or charged back in whole or in part, the corresponding commission is reversed in the same proportion. This can reduce your balance, including below zero if the reversal happens after a payout.
• Payouts. Payouts are made manually once your payable balance reaches the published minimum. Before your first payout we must have a completed tax form on file (Form W-9 for US persons, Form W-8BEN or equivalent otherwise). Payout methods and availability vary by country and any transfer fees or withholding taxes may be deducted.
• Prohibited conduct. Referring yourself, creating additional accounts, buying through your own link, bidding on our brand terms, spamming, or misrepresenting CV-BY-JD are not permitted. You must not describe the program in terms other than those published on the referral dashboard.
• Forfeiture. We may withhold or reverse commissions, and suspend or remove you from the program, if we reasonably believe it has been abused. Unpaid commissions are forfeited on removal.
• Independent status. Participating does not make you an employee, agent, or partner of CV-BY-JD, and you are responsible for any tax due on amounts you receive.

8. Intellectual Property

Your Content: You retain ownership of any content you provide to the Service (including your resume information). By using our Service, you grant us a limited license to process and display your content as necessary to provide the Service.

Our Content: All other content, including the Service itself, AI models, templates, and branding, remains our property or that of our licensors.

9. Prohibited Uses

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to reverse engineer or extract our AI models
• Scrape or harvest data from the Service
• Share your account with others
• Use the Service to harass, abuse, or harm others
• Upload malicious code or interfere with the Service
• Misrepresent yourself or create false identities

10. Limitation of Liability - Individual Operator

AS AN INDIVIDUAL OPERATOR, TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE SERVICE IS PROVIDED "AS IS" WITH ABSOLUTELY NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED
• THE OPERATOR ASSUMES NO LIABILITY WHATSOEVER FOR ANY DAMAGES, LOSSES, OR CONSEQUENCES ARISING FROM YOUR USE OF THE SERVICE
• THE OPERATOR DISCLAIMS ALL LIABILITY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• IN NO EVENT SHALL THE OPERATOR'S TOTAL LIABILITY EXCEED $10 USD OR THE AMOUNT YOU PAID IN THE PAST 30 DAYS, WHICHEVER IS LESS
• THE OPERATOR IS NOT LIABLE FOR ANY CAREER OUTCOMES, JOB APPLICATION RESULTS, DATA LOSS, SERVICE INTERRUPTIONS, OR ANY OTHER CONSEQUENCES
• YOU ASSUME ALL RISK AND LIABILITY FOR YOUR USE OF THE SERVICE

If you do not agree with these limitations, you must not use the Service.

11. Indemnification

You agree to indemnify, defend, and hold harmless CV-BY-JD, its operator, and any associated parties from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from your use of the Service or violation of these Terms.

12. Termination

We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms. Upon termination, your right to use the Service will immediately cease. The disclaimer, limitation of liability, and indemnification provisions survive termination.

Account Deletion: You may delete your account at any time through account settings. Upon deletion:

• All personal data will be permanently removed
• Unused credits will be forfeited without refund
• The process is irreversible
• Some anonymized data may be retained for legal compliance

13. Changes to Terms

We may update these Terms at any time. We will notify you of material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to a jury trial or class action lawsuit.
